Summary
The U.S. Environmental Protection Agency (EPA), Region III, is hereby giving notice that it proposes to enter into a Consent Agreement and Final Order ("CAFO"), which commences and concludes the administrative action against the Town of Bel Air, 39 N. Hickory Avenue, Bel Air, Maryland 21014. The CAFO assesses an administrative penalty of thirty-five thousand dollars ($35,000) under Section 309(g) of the Clean Water Act, 33 U.S.C. Section 1319(g) for violation of Section 402 of the Clean Water Act.
EPA Region III alleges that the Town of Bel Air failed to adhere to its National Pollutant Discharge Elimination System (NPDES) permits by failing to develop a program for the detection and elimination of illicit discharges from its Municipal Separate Storm Sewer System (MS4), failing to develop a stormwater pollution prevention plan for its maintenance facility, and failing to submit MS4 annual reports and include required information in its annual reports.
